700 Broadway, New York, NY 10003

Marie Ianniello Occhigrossi is a New York attorney whose work at Weitz & Luxenberg has included appeals and the lien, estate and bankruptcy questions that hold up settlement payments. In an April 17, 2026 application to a federal court in New Jersey, she used the title of counsel and sought appointment to the plaintiffs’ steering committee in the Johnson & Johnson talcum powder multidistrict litigation. Her application traced that work back to an assignment involving dismissed asbestos cases. The plaintiffs had died, and no one had been appointed to represent their estates. Instead of pursuing individual appeals, Occhigrossi arranged a coordinated appointment process so the cases could be restored or recommenced. Appellate practice had been her starting point at the firm. She described subsequent work on court-adopted lien procedures and an expedited route to appointing estate representatives. With court-appointed special masters, she also helped establish procedures for approving settlements and distributing proceeds to deceased claimants’ families. The committee role she proposed concerned delays in paying settlements, specifically those involving liens, probate and bankruptcy. Her application supplied a separate example from the Philips CPAP multidistrict litigation: unresolved Medicaid liens for Massachusetts and Rhode Island claimants had been returned to plaintiffs’ counsel, and she was addressing them for Weitz & Luxenberg. She also reported speaking on national panels about estate administration, lien resolution and personal bankruptcy in personal injury cases.
