Mr. Kiesel has extensive experience in complex litigation, including environmental, construction defect, product defect, and pharmaceutical actions. Mr. Kiesel currently serves as national Lead Counsel in the federal Multi-District Litigation against Glaxo Smith Kline for injuries caused by its pharmaceutical drug, Avandia. There are over 20,000 personal injury cases, a half-dozen consumer class cases, and several state actions pending in the Avandia MDL. Mr. Kiesel served as Liaison Counsel in the litigation arising out of the 2008 Chatsworth Metrolink crash that killed 24 individuals and injured over 100 people. As Liaison Counsel, Mr. Kiesel coordinated the successful resolution of the cases for $200 million, the maximum recovery allowed by law. Currently, Paul Kiesel represents many individuals and their families in significant personal injury and wrongful death cases. Among his many clients, Mr. Kiesel represented former Governor Gray Davis in a challenge to the qualification of the 2003 recall election. Mr. Kiesel currently represents numerous municipalities, including the City of Los Angeles, in a class action on behalf of all cities in the State of California for payment of occupancy taxes owed by the online travel industry.

Over his career, Paul has filed and defended dozens of anti-SLAPP motions. Paul’s work in this area contributed to Murphy Rosen being honored as “Best for Anti-SLAPP Motions in California” by Legal Elite. Paul is licensed to practice law in the states of California and New York, and has litigated and tried cases across the nation in state, federal and administrative law courts as well as in arbitration. He has also represented clients in various congressional investigations and has defended them in their testimony before Congress.

Peter G. Bertrand is Co-Chair of the Firm’s Trade Secret and Employee Mobility and Wine Industry Practice Groups. Mr. Bertrand’s practice, which is national in scope, focuses on the representation of financial institutions and companies in the areas of litigation, bankruptcy and creditor rights law. He also specializes in cases involving intellectual property, trade secrets, unfair business competition and employment related claims, and he has substantial experience in representing financial institutions in lender liability actions, interbank disputes and claims involving directors and officers. Mr. Bertrand has prepared and participated in a number of specialized programs involving bankruptcy, creditors’ rights (secured and unsecured), provisional and post-judgment remedies, high tech commercial law, commercial paper and employment law issues. He is a member of the Bar Association of San Francisco’s Commercial Law and Bankruptcy Section and has lectured extensively as part of educational programs geared toward financial institutions throughout the United States.
