Nathaniel Pitoniak built his career in the courtroom. As a former Assistant District Attorney in Harris County, he prosecuted misdemeanor and felony cases and tried cases before juries across Houston. That experience shaped the way he practices today. He prepares every case as though it may be presented to a jury and approaches each client’s situation with focus and discipline. Over nearly two decades in practice, Nathaniel has tried more than thirty jury trials, ranging from misdemeanors to serious felonies. His years as a prosecutor gave him extensive training in evaluating evidence, examining witnesses, and presenting clear, persuasive arguments. He understands how cases are built, how prosecutors assess risk, and what resonates with jurors inside the courtroom. In one serious felony case carrying a punishment range of 25 to 99 years in prison, Nathaniel persuaded a jury to return a Not Guilty verdict. After closing arguments, one of the prosecutors complimented his performance and asked him to consider returning to the District Attorney’s Office. Moments like that reflect the credibility he has earned through preparation and steady advocacy. His practice is not defined by trials alone. Nathaniel has obtained hundreds of dismissals in felony and misdemeanor cases. He has also secured substantial charge reductions in complex matters. In a case involving a murder allegation, the charge was reduced to second degree manslaughter with deferred adjudication probation, allowing his client to avoid incarceration. In another case, an intoxication manslaughter charge was reduced to misdemeanor DWI. For eligible clients, he has negotiated pre trial intervention agreements that allow cases to be dismissed after successful completion of specified conditions without a guilty plea. These outcomes have helped clients protect their immigration status and maintain professional licenses. Clients who work with Nathaniel often want clear answers and realistic guidance. He provides direct advice, thoughtful case analysis, and consistent communication throughout the process. Prosecutors know he is willing to try cases when necessary, and that reputation often shapes discussions long before a jury is selected. Nathaniel represents individuals from many backgrounds, including professionals, students, veterans, and non citizens. He understands that a criminal charge can affect employment, reputation, and long term opportunities. His focus is on positioning each case for the strongest possible resolution while standing ready to present a persuasive defense in court.

Robert L. Heston Jr. is president and chief executive officer of LegalEASE, a Houston-based provider of employee legal benefits. In describing the company’s service, Heston gives a specific role to the advocate who helps a member find an attorney: answering questions, taking intake information and establishing what the member needs. LegalEASE supplies access to a nationwide attorney network. His first job with the business was quite different. Legal Access Plans hired Heston in 1982 as the first attorney for its centralized consultation service. According to the company’s history, he found that his familiarity with Los Angeles did not equip him to advise callers elsewhere in California, where he lacked experience with local courts and judges. This mattered when a caller needed to weigh the likely outcome of a case against the expense of pursuing it. Heston recommended replacing the consultation center with a national attorney network and seeking larger clients. He became chief executive in 1984. As the network expanded within California and then beyond the state, Heston began devising the requirements and credentialing process for screening law firms. The company’s 1987 history entry records its decision to move the corporate headquarters to Houston for a more central location. The LegalEASE brand followed in 2006, when Legal Access Companies began marketing it nationally to employers and brokers. In a 2025 company article, Heston expressed his hope that legal benefits would become as essential as core health benefits.

The desire to help folks, and provide a service to them, took seed a long time ago. Looking back, it is easy to see that the idea of service to others, over service to self, took hold during my time at a Jesuit High School where I volunteered at the local Y to help younger kids in their afterschool program. This concept was reinforced when I attended the United States Military Academy (West Point), where I truly learned the value of service and saw the sacrifice that our veterans make. These lessons help guide me when working with clients, including being the program defense counsel for the Williamson County Veterans Treatment Court. During my legal career that now exceeds 30 years, I pride myself on always remembering what is important – the client. Whether it seems like a simple criminal trespass charge, a complicated fraud case, a domestic violence allegation, or driving while intoxicated charge, the key is always the client. My experience gives me the ability to analyze a situation quickly and thoroughly; however, it is not until I visit with the client that I am able to more fully understand what happened, what is the key evidence, and what the client is comfortable pursuing as opposed to trying to shoehorn the client into an uncomfortable position. While practicing for more than 30 years seems like a lot, and that I know what I need to, that is not the case. Every year I spend time attending seminars, both in Texas and put on by national authorities in their areas, to make sure I stay abreast of changes in the law, and best practices when it comes to, negotiating with the State before trial, or presenting your case in trial. Additionally, I stay abreast of changes in the community, whether it be the opening of a new gas station/convenience store, the opening of another new, make that six new, apartment complexes, or the addition/expansion of a subdivision. These changes impact the makeup of our jury pools, something to always keep in mind when dealing with a criminal case. While some crimes may be considered inexcusable, the last decade has seen shifts in what people think about certain types of behavior, and how what was once frowned upon may get a more favorable outcome with a jury deciding the punishment, as opposed to a judge. While my career allowed me to represent folks in State and Federal Courts across the country, become licensed in multiple states, and handle some very interesting matters, the last 15 years in Williamson County are some of the most personally fulfilling years of my career. Helping folks navigate the complexities of the criminal justice system, ensuring that their voice is heard, and that their individual rights are protected, are things that I truly enjoy.

Dick DeGuerin made his reputation handling tough cases, something he does to this day. He started as a prosecutor in the Harris County District Attorney’s Office in 1965, and moved to Butler Binion, a prominent civil firm, in 1968. In 1970, while Dick was still an associate at Butler Binion, federal authorities charged well known criminal-defense lawyer Bob Tarrant with illegal possession and sale of machine guns. Bob, who was colorful to say the least, had a collection of every Thompson model ever made. Dick knew and respected Bob from his time as a prosecutor and volunteered to assist Percy Foreman who was leading the defense. During the trial, Percy told Dick to “come see me when this is over.” He did. Dick sought Jack Binion’s counsel about the job Percy offered, and the advice was simple: “You’re a damn fool if you don’t take it.” When Dick took the job, Percy Foreman was already the man to see if you were in serious legal trouble. In a 1952 Houston murder trial, Percy contended that the elected Harris County Sheriff and a Texas Ranger beat a confession out of the defendant. The Sheriff and the Ranger were present when Percy gave his closing argument accusing them of the misconduct. After the not-guilty verdict was read, the Sheriff and the Ranger jumped the bar and assaulted Percy in the courtroom. Upon leaving the hospital shortly thereafter, Percy said “I harbor no malice toward these poor, misguided minions of the law.” The 1964 Florida trial of Candace Mossler was covered nationwide and solidified Percy’s courtroom reputation. She was acquitted of her husband’s murder in a case that was ahead of its time in subject matter and defensive approach. Dick left Foreman & DeGuerin in 1982 with Lewis Dickson, and they formed DeGuerin & Dickson. They continued the tradition of their former firm, aggressively representing their clients’ interests. That tradition remains.
