Mitchell Toups

Mitchell A. Toups is a Beaumont, Texas, attorney whose State Bar profile lists personal injury litigation and an affiliation with Weller Green Toups & Terrell LLP. His Texas license dates to May 13, 1983, and the bar lists him as eligible to practice.

Among his past cases is the National Football League players’ concussion litigation in the Eastern District of Pennsylvania. Toups represented the Armstrong Objectors, a group of settlement class members challenging the June 25, 2014 class action settlement agreement. In a declaration filed that October, he named Ramon Armstrong, Nathaniel Newton Jr., Larry Brown and Kenneth Davis among his clients. He described himself at the time as a firm partner with his principal office in Beaumont.

A later filing sets out the limits of that representation. In May 2018, Toups stated that Weller, Green, Toups & Terrell had represented 28 class members for purposes of settlement objections. The firm was not handling their individual settlement-benefit claims: those former clients were filing on their own or using other counsel. Toups also sought fees for what he described as the objectors’ improvements to the settlement.

His 2014 declaration listed licenses in Texas and New York and admission to the United States Supreme Court and Court of Federal Claims. It also listed five federal appeals courts and federal district courts in Texas, Wisconsin and Michigan.
