Kevin Kelly

Kevin J. Kelly practices employment and labor law, civil rights law and plaintiff-side personal injury law with The Mastromarco Firm in Saginaw, Michigan. Medical malpractice claims are also among the matters listed in his firm biography. His legal education and admission to practice both reached completion in 2010: he graduated from Wayne State University Law School and was admitted after passing the bar examination.

In the Michigan Supreme Court, Kelly represented James Stefanski in litigation against the Saginaw County 9-1-1 Communications Center Authority. The plaintiff’s reply brief, received by the court on May 13, 2024, names Kelly as its preparer and lists Victor J. Mastromarco, Jr. alongside him as counsel. Kelly signed the submission that day. In its accompanying certificate, he described himself as a shareholder of the firm and the attorney responsible for preparing the reply.

The argument turned on a statutory word: “law.” Addressing MCL 15.362, the reply maintained that the term encompassed common law, citing dictionary definitions in support of that reading. It sought reversal of the trial court and Court of Appeals decisions and reinstatement of Stefanski’s retaliation claim under the Whistleblowers’ Protection Act.
