About Dan

Dan Newman is a Nelson Mullins partner in Miami who litigates securities and complex commercial disputes. Listed on the firm’s professional roster as Daniel Newman, he began his career in the Securities and Exchange Commission’s Division of Enforcement, investigating and prosecuting federal securities-law violations. His work now includes representing individuals and organizations in SEC, Department of Justice, FINRA and state securities regulatory investigations and related litigation.

His cases span federal and state courts and arbitration. They include contract and commercial tort disputes, non-compete agreements, shareholder derivative actions, class actions and securities fraud claims. Among his representative matters are the defense of a Florida city in an SEC municipal-bond proceeding and representation of a chief financial officer in an SEC case concerning Sarbanes–Oxley officer certification. He also handles internal corporate investigations for entities, officers and directors.

Newman’s receivership work involves businesses prosecuted by the SEC for securities fraud, with recovery for defrauded investors as a focus. He has also acted as counsel to receivers. In construction litigation, he represents owners, developers and contractors in disputes over defects, delays, project scheduling and administration.

A 1991 graduate of the University of Miami School of Law, Newman previously led its law alumni association as president. His teaching experience includes SEC investigations at Miami Law and litigation skills at Nova Southeastern University’s Shepard Broad College of Law. In 2023, he received the Thomas Davison III Memorial Service Award at the University of Miami Law Association’s homecoming breakfast.
