James Napoli

Distinguished Lawyer

Health Care Law

1010 Wisonsin Ave, NW, 530, Washington, DC 20007

James Napoli is the founder and managing partner of Diceros Law PLLC, a Washington, D.C., firm serving employers and group health plans. His counseling work has included brokers and agents, employer groups, and healthcare-industry vendors. He has also written two books on the Affordable Care Act. Employee benefits were central to Napoli’s work before Diceros. In October 2014, he moved to Seyfarth Shaw’s Washington office from Constangy, Brooks & Smith, where he had co-chaired the ERISA practice. Seyfarth’s announcement described a background that extended from tax-qualified retirement plans to retiree medical issues. Among the employers he had advised on retiree medical matters were businesses in automotive manufacturing, steel, entertainment and transportation. That earlier work included disputes over benefits and alleged breaches of fiduciary duty under ERISA. Away from litigation, Napoli negotiated investment management and administrative services agreements. He had also defended clients in agency proceedings and audits, including matters brought by the Department of Labor and the Internal Revenue Service. Diceros’s published services focus on the legal and administrative needs of group health plans. The firm assists with vendor selection, cost-containment contracts and payment policies; it also reviews plan documents and helps prepare participant notices. On the disputes side, Diceros represents plans in contract and medical-provider reimbursement matters, as well as participants and covered dependents facing balance-billing disputes. The firm separately offers advice on HIPAA and ERISA fiduciary obligations.
